Does VAT on Digital Services Law mean higher fees?

BIR cannot prevent foreign digital service providers from increasing fees

Ganap nang batas ang Value Added Tax (VAT) on Digital Services.

Nilagdaan ni Pangulong Bongbong Marcos ang Republic Act 12023 nitong Miyerkules, October 2, 2024.

Ibig sabihin nito, sisingilin ng 12% VAT ang foreign digital services, streaming platforms, and online marketplaces.

Kasama rito ang streaming platforms na Netflix, Amazon Prime, Disney Plus, at Spotify; at ang online shopping site na Amazon.

Based man abroad ang online o digital services na ito, kumikita pa rin ang mga ito dahil tinatangkilik ng mga Pinoy.

Inaasahang kikita ang gobyerno ng tinatayang PHP102 billion sa susunod na limang taon dahil sa 12% VAT na ipapataw sa digital service providers.

Nilinaw naman ng Malacañang na hindi na ito bagong batas dahil dati nang nagbabayad ng 12% VAT ang local digital service providers.

Pinagtibay lamang ito ngayon para magbayad din ang foreign digital service providers na ina-avail ng Filipino consumers.

POSSIBLE PRICE INCREASE IN SERVICES

Ang tanong ngayon, dahil sa pagpataw ng buwis sa non-resident service providers na ito, magtataas din ba sila ng singil?

Hindi ito malayong mangyari. Galing mismo ito kay Bureau of Internal Revenue (BIR) Commissioner Romeo Lumagui Jr.

Ayon sa commissioner, hindi nila puwedeng pagbawalan ang digital service providers kung plano nilang magtaas ng presyo.

Pero umaasa naman siyang hindi ganoon kalaki ang ipapataw na increase ng fee sa kanilang services.

Sabi niya, “If they will increase their prices by so much, they will also lose their customers at the same time.

“So I’m sure they will not do that. It’s not a wise decision.”

Dagdag niya sa posibleng pagtaas ng singil, “It’s a business decision by the service providers.

“So puwedeng magkaroon ng price increase. But, again, I think it would be minimal. It will not be 12 percent automatically.”

Naniniwala naman si Mon Abrea, isang tax expert, na ang publiko ang sasalo ng dagdag singil.

“So definitely, ipapasa lang nila talaga sa consumers. That’s why we were recommending before na dapat i-require muna na mag-register at magbayad sila ng income tax dito,” ani Abrea sa interview ng News5.

Ang service providers na hindi susunod sa batas ay ipapa-block para hindi na makapag-operate, ulat naman ng GMA Integrated News.

EXEMPTED DIGITAL SERVICES

Sa kabilang banda, may digital services na exempted sa VAT on Digital Services Law.

Ang mga exempted sa batas ay education services, tulad ng online courses, online seminars, and online trainings mula sa private institutions.

Gayundin ang mga digital content services na accredited ng Department of Education, Commission on Higher Education, Technical Education and Skills Development Authority, at iba pang government education institutions.

Mayroong 90 days ang gobyerno para maglatag ng implementing rules and regulations para sa nilagdaang batas, kaya’t inaasahang ipatutupad pa ito sa susunod na taon.
