DOLE ipinaalala sa employers ang pagbabayad ng 13th month pay

Naglabas ang Department of Labor and Employment ng advisory kung hanggang kailan dapat magbayad ang employers ng 13th month pay, at kung magkano ang dapat na matanggap ng mga empleyado.

Ipinaalala ng Department of Labor and Employment (DOLE) sa private-sector employers na dapat i-release ang 13th month pay ng kanilang mga empleyado nang hindi lalampas sa December 24, 2023.

Inilabas ni DOLE Secretary Bienvenido E. Laguesma ang Labor Advisory No. 25, Series of 2023, noong November 8 para magabayan ang mga employers at mga empleyado tungkol sa tamang computation ng naturang mandatory benefit, alinsunod sa Labor Code of the Philippines at Presidential Decree No. 851.

Ang PD No. 851 ang partikular na nag-aatas sa lahat ng employers na bayaran ang kanilang mga empleyado ng 13th month pay.

Batay sa advisory, ang minimum 13th month pay ay hindi dapat na mababa sa one-twelfth (1/12) ng total basic salary na kinita ng empleyado sa loob ng calendar year.

Naririto ang computation:

Total basic salary/12 months=proportionate 13th month pay

Binigyang-diin sa inilabas na advisory ni Laguesma na ang 13th month pay “shall be paid to rank-and-file employees in the private sector regardless of their position, designation, or employment status, and irrespective of the method by which their wages are paid, provided that they have worked for at least one month during the calendar year.”

Makakatanggap din ng naturang benepisyo ang “rank-and-file employees who are paid on a piece-rate basis, fixed, or guaranteed wage plus commission; those with multiple employers; those who resigned; those who were terminated from employment; or those who were on maternity leave and received salary differential.”

Nilinaw rin ng DOLE na hindi tatanggap ang ahensiya ng anumang requests para sa exemption or deferment sa pagbabayad ng 13th month pay mula sa mga employers.

Para ma-monitor ng ahensiya, inaatasan ang mga employers na magsumite ng report sa pamamagitan ng DOLE Establishment Report System nang hindi lalampas sa January 15, 2024.

Ang report ay dapat na nagtataglay ng pangalan ng kumpanya, address, principal product or business, kabuuang bilang ng mga empleyado, kabuuang bilang ng mga empleyadong nakatanggap ng 13th month pay, magkano ang halaga na natanggap ng kada empleyado, at kung magkano ang kabuuang halaga na ibinayad ng kumpanya.

Ang DOLE Regional/Field/Provincial Office na may hurisdiksiyon sa workplace ang magmo-monitor kung nag-comply ang mga kumpanya sa general labor standard.
