Nilagdaan na ni Pangulong Ferdinand “Bongbong” Marcos Jr. ang Republic Act No. (RA) 11934, o ang “An Act Requiring the Registration of SIM Cards” ngayong October 10, 2022, sa Malacañang Palace.
Layunin ng bagong batas na ma-regulate ang pagbebenta ng subscriber identity module (SIM) cards para masugpo ang paglaganap ng text message scams sa bansa.
Ang RA 11934 ang kauna-unahang batas na nilagdaan ni Marcos Jr.
Pinasalamatan ng Pangulo ang mga mambabatas mula sa Mataas at Mababang Kapulungan dahil sa paglikha ng aniya ay “long overdue” na batas para maresolba ang mga krimen kaugnay ng paggamit ng SIM cards.
Ani Marcos Jr., “Truly, the legislation is going to be welcomed by many of our people especially now with reports of the commission of various crimes using mobile phones, including the proliferation of text scams and spam.
“Indeed with the signing of this law, we set the important tone that it is our national policy to ensure that technology shall only be used to improve our people’s lives.”
VALID ID BAGO MAKABILI NG SIM CARD
Sa ilalim ng RA 11934, inaatasan ang Public Telecommunication Entities (PTEs) o ang mga direct sellers na i-require sa end users ng SIM cards na magpakita ng valid identification document para matiyak ang kanilang pagkakakilanlan.
Kailangan din ng PTEs na magsumite ng verified list ng kanilang authorized dealers and agents sa buong bansa sa National Telecommunications Commission (NTC).
Ang verified list ay kailangang i-update kada tatlong buwan taun-taon.
Itinatakda rin ng RA 11934 na ang lahat anng PTEs ay kailangang mag-maintain ng SIM Card Registry ng kanilang subscribers na nagtataglay ng mga impormasyon na ayon sa mga hinihingi ng bagong batas.
CONFIDENTIALITY CLAUSE
May probisyon para sa Confidentiality and Non-disclosure of Information na nagbabawal isapubliko ang anumang impormasyon tungkol sa subscriber.
Maliban na lang kung may subpoena o utos mula sa korte, o written request mula sa law enforcement agency kaugnay ng isinasagawang imbestigasyon, na ang partikular na numero ay ginamit sa paggawa ng krimen.
Batay sa RA 11934, magkakabisa ang confidentiality clause sa SIM card registration matapos mabili ng subscriber ang phone number.
Para naman sa mga existing prepaid SIM card phone subscribers, magkakabisa ang confidentiality clause matapos itong maiparehistro.
Ang mga subscribers na mabibigong mag-comply sa itinakdang period of registration ay mahaharap sa automatic deactivation of services ng kanilang existing prepared SIM card.
PAGPAPAREHISTRO ITATAKDA PA NG NTC AT PTEs
Sinabi ni Department of Information and Communications Technology Secretary Ivan John Uy na ang time frame para maiparehistro ang SIM cards ay madedesisyunan matapos ang konsultasyon sa pagitan ng NTC at PTEs.
Ani Uy, “I think the prescribed time has still to be set by NTC and with the consultation with the telcos kasi they have to prepare the systems, they have to prepare their people in order to do this.
“But I think madali na, maraming process.”
Maaari aniyang ikonsidera ng PTEs na sabihin sa kanilang subscribers na i-validate ang kanilang SIM cards online gaya ng ginagawa sa electronic wallets para maiwasan ang mahahabang pila sa kanilang physical stores.
Paliwanag ni Uy, “Nandun na rin yung data, especially the post-paid ones, nandun na.
“So they just have to revalidate whether the one who’s using the phone is the same one that applied.”
Aminado naman ang opisyal na challenging ang pagpaparehistro ng prepaid SIM cards.
“They [subscribers] would still receive a notice that, ‘Okay, Mr. Anonymous, in view of the SIM Card Registration Bill please log in to this site and you will receive a verification text on your phone that you are indeed the owner of that phone.’
“Those who failed to do that probably would be given a few chances to do it over a period of time, otherwise they would be cut off.”
Para matiyak na ang mga nagpaparehistro ng SIM cards ay legitimate individuals, sinabi ni Uy na ang isusumiteng identification (ID) cards gaya ng driver’s license at passports ay maaaring i-validate ng mga kinauukulang ahensya, gaya ng Land Transportation Office at Department of Foreign Affairs.
