Walang katotohanan ang mga haka-haka at balitang tetestigo laban kina Tito Sotto, Vic Sotto, at Joey de Leon si former TAPE Inc. SVP at COO Malou Choa-Fagar.
Ito ay kaugnay sa isyu ng Application of the Issuance of Writ of Injuction na inihain ng TVJ at ni Jeny Ferre sa Branch 273 ng Regional Trial Court ng Marikina City.
Si Ferre ang dating creative director ng Eat Bulaga! at siyang utak sa karamihan ng patok na segments ng longest-running noontime show gaya ng "Pinoy Henyo," "Bawal Judgmental," "Sugod Bahay," at "Kalyeserye."

Binabatikos si Fagar dahil marami ang nagkamali sa pag-intindi sa pahayag ni Atty. Maggie Abraham-Garduque, ang legal counsel ng TAPE Inc., tungkol sa mga testigong ihaharap niya sa korte at makapagbibigay-linaw sa nabanggit na usapin.
Masasakit na salita ang ipinupukol kay Fagar dahil sa maling akala na tatayo siyang testigo laban sa mga dating host ng Eat Bulaga! na nagnanais na maangkin ang naturang pamagat at ang ibang mga segment ng dating programa nila na ang TAPE Inc. ang producer.

Ang pangalan ni Fagar ang isa sa mga binanggit ni Garduque nang tanungin ito tungkol sa mga saksing ipiprisinta ng TAPE sa korte.
Pero malinaw sa kanyang pahayag na magiging testigo ang dating executive ng kompanya para patunayang empleyado si Ferre.
Pahayag ni Garduque: “On the part of TAPE Inc., we will be presenting five witnesses. So, nandun yung admin staff and finance staff ng TAPE Inc. to be able to prove na employee talaga si Jeny Ferre.
“May mga evidence kami on the admin proving her employment thereby she’s not entitled to the copyright of the show and of its segments because she was an employee of TAPE Inc.
“With the finance department, of course, we can show proof na talagang employee si Jeny Ferre and also talent fees of TVJ.
"And also, we can show that all the expenses of production, just like what was admitted today, was submitted today is being paid… all of the expenses for production paid by TAPE Inc.
“We have representative from admin, from finance, Vincent Dy Buncio, the previous creatives head of Eat Bulaga! from 1979 to 1989.
“He was actually the one who conceptualized the segment 'Mr. Macho [Man],' the one which has saved Eat Bulaga! from cancellation before.
“We are also going to present Malou Choa-Fagar, the previous SVP and COO of TAPE Inc.
"She also handled the position of Jeny Fere before when Jeny Ferre was under her and when Jeny Ferre was hired by TAPE Inc. in 1994."
Naiwasan o hindi sana nangyari ang mga walang katarungang paghuhusga at matitinding batikos laban kay Fagar kung hindi muna binanggit ang pangalan ng mga saksi dahil hindi inunawang mabuti ng mga nakikisimpatiya sa TVJ ang mga pahayag ni Garduque.
